Terms of Use

These Terms of Use (“Terms” or “Terms of Use”) are a binding legal agreement between you and HuntNHook, Inc., a Delaware corporation, that governs the right to use huntnhook.com and/or the HuntNHook mobile application for iOS and Android (together, the “Platform”). When used in these Terms, “Company,” “HuntNHook,” “we,” “us,” or “our” refers to HuntNHook, Inc.

Please read the Terms of Use carefully before you start to use the Platform. By clicking to accept or agree to the Terms of Use, you accept and agree to be bound and abide by these Terms of Use and our Privacy Policy, found at https://huntnhook.com/legal/privacy, incorporated herein by reference, as well as other policies and terms incorporated by reference in these Terms, including our Community Guidelines, found at https://huntnhook.com/community-guidelines. If you do not want to agree to these Terms of Use or the Privacy Policy, you must not access or use the Platform.

The Platform enables users (“Users”) to publish, offer, search for, and book services. Users who publish and offer services are “Hosts” and Users who search for, book, or use services are “Guests.” Hosts offer accommodations and lodging (“Accommodations”) and a variety of outdoor services and experiences, including guided and self-guided fishing and hunting trips and land access (collectively, “Host Services,” and each Host Service offering, a “Listing”). As the provider of the Platform, the Company does not own, control, offer or manage any Listings or Host Services. We are not a party to the contracts entered into directly between Hosts and Guests, nor are we a real estate broker, travel agency, outfitter, guide service, or insurer. We are not acting as an agent in any capacity for any User, except as specified in Payments, Fees, and Payouts below with respect to collecting and remitting payments.

We maintain other terms and policies, including the Privacy Policy and the Community Guidelines.

This Platform is offered and available to users who are 18 years of age or older. By using this Platform, you represent and warrant that you are of legal age to form a binding contract with the Company and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Platform.

We may revise and update these Terms of Use from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Platform thereafter. However, any changes to the dispute resolution provisions set out in the Governing Law and Jurisdiction section below will not apply to any disputes for which the parties have actual notice on or before the date the change is posted on the Platform.

Your continued use of the Platform following the posting of revised Terms of Use means that you accept and agree to the changes. You are expected to check this page each time you access this Platform so you are aware of any changes, as they are binding on you.

We reserve the right to withdraw or amend this Platform, and any service or material we provide on the Platform, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Platform is unavailable at any time or for any period. From time to time, we may restrict user access, including registered User access, to some parts of the Platform or the entire Platform.

You are responsible for making all arrangements necessary for you to have access to the Platform.

To access the Platform as a Guest or Host, you will be asked to provide certain registration details or other information. It is a condition of your use of the Platform that all the information you provide on the Platform is correct, current, and complete. You agree that all information you provide to register with this Platform or otherwise, including, but not limited to, through the use of any interactive features on the Platform, is governed by our Privacy Policy (https://huntnhook.com/legal/privacy), and you consent to all actions we take with respect to your information consistent with our Privacy Policy.

You must register an account to access and use the Platform as a Guest or Host. Registration is only permitted for legal entities, partnerships and natural persons who are 18 years or older. You will need to provide your first and last name, date of birth, and email address, and may be required to provide other information. You may be allowed to sign in with, or link your account to, your Google or Apple account. You represent and warrant that you are not a person or entity barred from using the Platform under the laws of the United States, your place of residence, or any other applicable jurisdiction. You must provide accurate, current, and complete information during registration and keep your account information up-to-date. You may not transfer your account to someone else. You will need to create a password, or use other supported sign-in credentials, as part of our security procedures upon registration. You are responsible for maintaining the confidentiality and security of your account credentials and may not disclose your credentials to any third party. You are responsible and liable for activities conducted through your account and must immediately notify the Company if you suspect that your credentials have been lost, stolen, or your account is otherwise compromised. If and as permitted by applicable law, we may, but have no obligation to (i) ask you to provide identification or other information, (ii) undertake checks designed to help verify your identity or background, (iii) screen you against third-party databases or other sources and request reports from service providers, and (iv) obtain reports from public records of criminal convictions or sex offender registrations or their local equivalents. Hosts who wish to receive payouts must additionally complete identity verification with our payments partner, Stripe, as described in Payments, Fees, and Payouts below.

For the purpose of compliance with any applicable Know Your Customer (“KYC”) or Anti-Money Laundering (“AML”) laws and regulations, we may ask you to verify your identity and provide information for that end before you are able to access or use the Platform. We may also take any action that we in our sole discretion believe to be necessary or desirable to comply with any KYC or AML laws and regulations.

We have the right to disable any account credential or other identifier, whether chosen by you or provided by us, at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms of Use.

The Platform and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by the Company, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms of Use permit you to use the Platform for your personal, non-commercial use only, unless expressly stated otherwise in these Terms of Use (including a Host's use of the Platform to offer Host Services in accordance with these Terms). You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Platform, except as follows:

• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
• You may store files that are automatically cached by your Web browser for display enhancement purposes.
• You may print or download one copy of a reasonable number of pages of the Platform for your own personal, non-commercial use and not for further reproduction, publication, or distribution.
• If we provide desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided you agree to be bound by our end user license agreement for such applications.
• If we provide social media features, you may take such actions as are enabled by such features.

You must not:

• Modify copies of any materials from this Platform.
• Use any illustrations, photographs, video or audio sequences, or any graphics separately from the accompanying text.
• Delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from the Platform.

You must not access or use for any commercial purposes any part of the Platform or any services or materials available through the Platform, unless expressly stated otherwise in these Terms of Use.

If you print, copy, modify, download, or otherwise use or provide any other person with access to any part of the Platform in breach of the Terms of Use, your right to use the Platform will stop immediately and you must, at our option, return or destroy any copies of the materials you have made. No right, title, or interest in or to the Platform or any content on the Platform is transferred to you, and all rights not expressly granted are reserved by the Company. Any use of the Platform not expressly permitted by these Terms of Use is a breach of these Terms of Use and may violate copyright, trademark, and other laws.

The Company name, the HuntNHook name and logo, the tagline “Book the Outdoors,” and all related names, logos, product and service names, designs, and slogans are trademarks of the Company or its affiliates or licensors. You must not use such marks without the prior written permission of the Company. All other names, logos, product and service names, designs, and slogans on this Platform are the trademarks of their respective owners.

You may use the Platform only for lawful purposes and in accordance with these Terms of Use. You agree not to use the Platform:

• In any way that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the US or other countries).
• For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information, or otherwise.
• To send, knowingly receive, upload, download, use, or re-use any material that does not comply with the Content Standards set out in these Terms of Use.
• To transmit, or procure the sending of, any advertising or promotional material without our prior written consent, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation.
• To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity (including, without limitation, by using email addresses or screen names associated with any of the foregoing).
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Platform, or which, as determined by us, may harm the Company or users of the Platform, or expose them to liability.

Additionally, you agree not to:

• Use the Platform in any manner that could disable, overburden, damage, or impair the Platform or interfere with any other party's use of the Platform, including their ability to engage in real time activities through the Platform.
• Use any automatic device, process, or means to access the Platform for any purpose, including monitoring or copying any of the material on the Platform, or scraping or harvesting data from the Platform (including for the training of machine-learning or artificial-intelligence models), without our prior written consent.
• Use any manual process to monitor or copy any of the material on the Platform, or for any other purpose not expressly authorized in these Terms of Use, without our prior written consent.
• Use any device, software, or routine that interferes with the proper working of the Platform.
• Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Platform, the server on which the Platform is stored, or any server, computer, or database connected to the Platform.
• Attack the Platform via a denial-of-service attack or a distributed denial-of-service attack.
• Otherwise attempt to interfere with the proper working of the Platform.

The Platform will contain Listings, personal web pages or profiles, reviews, and may contain other interactive features (collectively, “Interactive Services”) that allow users to post, submit, publish, display, or transmit to other users or other persons (hereinafter, “post”) content or materials (collectively, “User Contributions”) on or through the Platform.

All User Contributions must comply with the Content Standards set out in these Terms of Use.

Any User Contribution you post to the Platform will be considered non-confidential and non-proprietary. By providing any User Contribution on the Platform, you grant us and our affiliates and service providers, and each of their and our respective licensees, successors, and assigns the right to use, reproduce, modify, perform, display, distribute, and otherwise disclose to third parties any such material for any purpose.

You represent and warrant that:

• You own or control all rights in and to the User Contributions and have the right to grant the license granted above to us and our affiliates and service providers, and each of their and our respective licensees, successors, and assigns.
• All of your User Contributions do and will comply with these Terms of Use.

You understand and acknowledge that you are responsible for any User Contributions you submit or contribute, and you, not the Company, have full responsibility for such content, including its legality, reliability, accuracy, and appropriateness.

We are not responsible or liable to any third party for the content or accuracy of any User Contributions posted by you or any other user of the Platform.

We have the right to:

• Remove or refuse to post any User Contributions for any or no reason in our sole discretion.
• Take any action with respect to any User Contribution that we deem necessary or appropriate in our sole discretion, including if we believe that such User Contribution violates the Terms of Use, including the Content Standards, infringes any intellectual property right or other right of any person or entity, threatens the personal safety of users of the Platform or the public, or could create liability for the Company.
• Disclose your identity or other information about you to any third party who claims that material posted by you violates their rights, including their intellectual property rights or their right to privacy.
• Take appropriate legal action, including without limitation, referral to law enforcement, for any illegal or unauthorized use of the Platform.
• Suspend or limit your access to or use of the Platform and/or your account, suspend, remove, disable access to, or restrict visibility of Listings, reviews, or other content, cancel pending or confirmed bookings, or terminate or suspend your access to all or part of the Platform for any or no reason, including without limitation, any violation of these Terms of Use, our Community Guidelines, applicable laws, regulations, or third-party rights, or if the Company believes it is reasonably necessary to protect the Company, its Users, or third parties.

Without limiting the foregoing, we have the right to cooperate fully with any law enforcement authorities or court order requesting or directing us to disclose the identity or other information of anyone posting any materials on or through the Platform. YOU WAIVE AND HOLD HARMLESS THE COMPANY AND ITS AFFILIATES, LICENSEES, AND SERVICE PROVIDERS FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY THE COMPANY OR ANY OF THE FOREGOING PARTIES DURING, OR TAKEN AS A CONSEQUENCE OF, INVESTIGATIONS BY EITHER THE COMPANY, SUCH PARTIES, OR LAW ENFORCEMENT AUTHORITIES.

However, we do not undertake to review material before it is posted on the Platform and cannot ensure prompt removal of objectionable material after it has been posted. Accordingly, we assume no liability for any action or inaction regarding transmissions, communications, or content provided by any user or third party. We have no liability or responsibility to anyone for performance or nonperformance of the activities described in this section.

These content standards apply to any and all User Contributions and use of Interactive Services. User Contributions must in their entirety comply with all applicable federal, state, local, and international laws and regulations, and with our Community Guidelines. Without limiting the foregoing, User Contributions must not:

• Contain any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.
• Promote sexually explicit or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
• Infringe any patent, trademark, trade secret, copyright, or other intellectual property or other rights of any other person.
• Violate the legal rights (including the rights of publicity and privacy) of others or contain any material that could give rise to any civil or criminal liability under applicable laws or regulations or that otherwise may be in conflict with these Terms of Use and our Privacy Policy (https://huntnhook.com/legal/privacy).
• Be likely to deceive any person, including through inaccurate Listing photos, descriptions, or pricing.
• Promote any illegal activity, or advocate, promote, or assist any unlawful act, including unlawful hunting or fishing.
• Cause annoyance, inconvenience, or needless anxiety or be likely to upset, embarrass, alarm, or annoy any other person.
• Impersonate any person or misrepresent your identity or affiliation with any person or organization.
• Involve commercial activities or sales, such as contests, sweepstakes, and other sales promotions, barter, or advertising, unless otherwise provided in these Terms of Use.
• Give the impression that they emanate from or are endorsed by us or any other person or entity, if this is not the case.

If you believe that any User Contributions violate your copyright, please send a notice of copyright infringement to team@huntnhook.com. Your notice should include: (i) identification of the copyrighted work you claim has been infringed; (ii) identification of the material you claim is infringing and its location on the Platform; (iii) your name, address, telephone number, and email address; (iv) a statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law; (v) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner’s behalf; and (vi) your physical or electronic signature. It is the policy of the Company to terminate the user accounts of repeat infringers.

The Platform may allow direct messages between Users (“Direct Messages”). ANY DIRECT MESSAGES SENT BETWEEN USERS THROUGH THE PLATFORM’S MESSAGING SYSTEM WILL BE ACCESSIBLE BY THE COMPANY FOR PURPOSES OF MONITORING AND ENFORCEMENT.

The Company will not disclose the contents of any Direct Messages to any third party, except as required by valid legal process, such as a subpoena or court order. The Company will not voluntarily cooperate with any third party seeking access to any user's Direct Messages without the express consent of the affected user(s), except as necessary to comply with applicable laws or regulations.

Users shall not attempt to access or intercept other Users' Direct Message communications.

Users shall not utilize the Direct Message system for any illegal, harmful, or offensive activities prohibited under these Terms of Use or any applicable laws or regulations. Direct Messages must comply with the Content Standards as described in these Terms.

Searching and Booking

You can search for Host Services by using different criteria. You can also use filters to refine your search results. Search results are based on their relevance to your search and other criteria.

When you book a Listing, you are agreeing to pay all charges for your booking, including the Listing price, any add-on services, applicable service fees, taxes, offline fees disclosed in the Listing, and any other items identified during checkout (see Payments, Fees, and Payouts below).

A booking may be a request that requires the Host’s acceptance. When you receive the booking confirmation, a contract for Host Services (a “Reservation”) is formed directly between you and the Host. By making a Reservation you are agreeing to the terms of the contract. It is your responsibility to read and understand these terms of the contract, including these Terms and all terms of the Reservation, including all rules, standards, policies, and requirements, and the applicable cancellation policy, prior to booking.

Accommodation Reservations

An Accommodation Reservation is a limited license to enter, occupy, and use the Accommodation. The Host retains the right to re-enter the Accommodation during your stay, to the extent: (i) it is reasonably necessary, (ii) permitted by your contract with the Host, and (iii) permitted by applicable law. If you stay past checkout, the Host has the right to make you leave in a manner permitted by applicable law, including by imposing reasonable overstay penalties. You may not exceed the maximum number of allowed Guests.

Reservations for Host Services

A Host Service Reservation entitles you to participate in, attend, or use that Host Service. You are responsible for confirming that you, and anyone you invite, meet minimum age, proficiency, fitness, licensing or other requirements, including holding any hunting or fishing licenses, tags, or permits the activity and jurisdiction require. You are responsible for informing the Host of any medical or physical conditions, or other circumstances that may impact your ability to participate, attend, or use the Host Service. Except where expressly authorized, you may not allow any person to join a Host Service unless they are included as an additional guest during the booking process.

Your Responsibilities

You are responsible and liable for your own acts and omissions and are also responsible for the acts and omissions of anyone you invite to join or provide access to any Accommodation, all areas and facilities where the Accommodation is located that the Host and Guest are legally entitled to use in connection with the Accommodation (“Common Areas”), or any Host Service. For example, this means: (i) you are responsible for leaving an Accommodation (and related personal property) or Common Areas in the condition it was in when you arrived, (ii) you are responsible for paying all reasonable damage claim amounts, and (iii) you must act with integrity, treat others with respect, and comply with applicable laws at all times.

Your Assumption of Risk

You acknowledge that many activities, including hunting and fishing, the possession and/or use of weapons, devices, or hunting or fishing methods and practices, carry inherent risks and agree that, to the maximum extent permitted by applicable law, you assume the entire risk arising out of your access to and use of the Platform and any content therein, including your stay at any Accommodation, participation in or use of any other Host Service, or any other interaction you have with other Users whether in person or online. This means it is your responsibility to investigate a Host Service to determine whether it is suitable for you. For example, Host Services may carry risk of illness, bodily injury, disability, or death, and you freely and willfully assume those risks by choosing to participate in those Host Services.

You acknowledge that to the fullest extent provided by law the Host (including our affiliates and personnel) will not be liable for any incidental, special, exemplary or consequential damages, including lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services, or for any damages for personal or bodily injury or emotional distress arising out of or in connection with (i) the use of or inability to use the Accommodation or Host Services booked via the Platform, or (ii) any communications, interactions or meetings you may have with someone you interact or meet with through, or as a result of, your use of the Accommodation or Host Services, whether based on warranty, contract, tort (including negligence), product liability or any other legal theory.

You acknowledge and agree that any hunting, fishing or similar activity (“Hunting Activity”) undertaken by Guests and Hosts shall be conducted in accordance with all applicable federal, state, and local laws and regulations. The User assumes full responsibility for understanding and complying with all relevant legal requirements pertaining to hunting, the carrying and use of firearms and other weapons, devices, or hunting and fishing methods and practices. Additionally, the User is responsible for adhering to all regulations regarding the possession and/or transportation of any hunted game or caught fish, including any customs or regulatory clearances.

You acknowledge and agree that any animals, plants, or other natural resources that are legally hunted and obtained by the Guest shall, upon the successful taking or harvesting of said resources, become the personal property of the Guest, provided that all applicable laws and regulations, these Terms, and the terms of the contract with the Host have been followed, unless otherwise provided by the contract between the Guest and Host.

The Company makes no claim of ownership or rights with respect to any hunted items obtained by the Guest.

Host

As a Host, you have the right to use the Platform in accordance with these Terms to share your Accommodation or other Host Service with Guests and earn money doing it. You as a Host are in control of how you host: set your price, availability, and rules for each Listing. You as a Host acknowledge and agree that you are a lawfully incorporated, registered or otherwise lawfully operating business (whether a corporation, a limited liability company, a partnership, a sole proprietor or other business type allowed under applicable law to engage in business activity and offer applicable Host Services or Accommodations), that you have and will maintain all registrations, licenses, incorporations, permits or any other similar documents necessary to operate a business and offer applicable Host Services or Accommodations under all applicable federal, state, local and international laws and regulations, including, but not limited to applicable hunting, fishing, hunted animal transportation, customs or other laws and regulations, and, where applicable, guiding or captain credentials such as a USCG license.

Contracting with Guests

When you accept a booking request, or receive a booking confirmation through the Platform, you are entering into a contract directly with the Guest(s), and are responsible for delivering the Host Service under the terms and at the price specified in your Listing. You are also agreeing to pay applicable fees (and applicable guest taxes) for each booking. Any terms or conditions that you include in any supplemental contract with Guests must: (i) be consistent with these Terms, our Privacy Policy, and the information provided in your Listing, and (ii) be prominently disclosed in your Listing description.

Independence of Hosts

Your relationship with us is that of an independent individual or entity and not an employee, agent, joint venturer, or partner of the Company. We do not direct or control your Host Service, and you understand that you have complete discretion whether and when to provide Host Services, and at what price and on what terms to offer them.

Creating and Managing Your Listing

As a Host, your Listing must include complete and accurate information about your Host Service, your price, other charges like offline and other fees (as applicable), and any rules or requirements that apply to your Guests or Listing. You are responsible for your acts or omissions as well as keeping your Listing information (including calendar availability) and content (like photos) up-to-date and accurate at all times. You are responsible for obtaining appropriate insurance for your Host Services and we suggest you carefully review policy terms and conditions including coverage details and exclusions. You may only maintain one Listing per Accommodation or Host Service.

Know Your Legal Obligations

You are responsible for understanding and complying with any laws, rules, regulations, and contracts with third parties that apply to your Listing or Host Services, including, if applicable, all laws and regulations pertaining to Hunting Activity. For the avoidance of doubt, it is your responsibility to obtain any required hunting or fishing licenses, permits, firearm or other weapons licenses and permits, and abide by all applicable laws and regulations. Check your local rules to learn what rules apply to the Host Services you plan to offer. Information we may provide regarding legal requirements is for informational purposes only and you should independently confirm your obligations. You are responsible for handling and using personal data of Guests and others in compliance with applicable privacy laws and these Terms. If you have questions about how local laws apply you should always seek legal advice.

Search Results

Search results are based on their relevance to a Guest's search and other criteria. Relevance considers factors like price, availability, reviews, customer service and cancellation history, popularity, previous trips and saved Listings, Host requirements (e.g. minimum or maximum nights), and more.

Your Responsibilities

As a Host, you are responsible and liable for your own acts and omissions and are also responsible for the acts and omissions of anyone you allow to participate in providing your Host Services. You are responsible for setting your price and establishing rules and requirements for your Listing. You must describe any and all fees and charges in your Listing description and may not collect any additional fees or charges outside the Platform. Do not encourage Guests to create third-party accounts, submit reviews, provide their contact information, or take other actions outside the Platform.

Your Assumption of Risk

As a Host, you acknowledge that hosting, including providing hunting and fishing related services or other services or Accommodations, carries inherent risks and agree that you assume the entire risk arising out of your access to and use of the Platform, offering Accommodation and/or Host Services, or any interaction you have with other Users whether in person or online. You agree that you have had the opportunity to investigate the Platform and any laws, rules, regulations, or obligations that may be applicable to your Listings or Host Services and that you are not relying upon any statement of law made by us.

Host Taxes

As a Host, you are responsible for determining and fulfilling your obligations under applicable laws to report, collect, remit, or include in your price any applicable VAT or other indirect taxes, occupancy taxes, tourist, income, or other taxes (“Taxes”) pursuant to the requirements of applicable laws, except to the extent such Taxes are calculated, collected, and remitted through the Platform as described in Payments, Fees, and Payouts below.

Payment Processing. Payments on the Platform are processed by our third-party payments partner, Stripe, Inc. and its affiliates (“Stripe”). By making or accepting a booking, you agree to be bound by Stripe’s applicable terms of service. Your payment card details and bank account details are collected and processed directly by Stripe. We do not store your full card number or bank account details on our servers.

Guest Payments. When you book a Listing, you authorize us (through Stripe) to charge your payment method for the total price shown at checkout, including the Listing price, any add-on services, applicable service fees, and applicable taxes. Where a booking is a request that requires the Host’s acceptance, your payment method is charged when the Host accepts your booking request, unless otherwise stated at checkout.

Service Fees. We charge service fees for use of the Platform, which may be payable by Guests, Hosts, or both. Any service fee payable by a Guest is displayed at checkout before the booking is confirmed. Any service fee payable by a Host is deducted from the Host’s payout. Except as expressly stated at checkout, provided in the applicable cancellation policy, or required by applicable law, service fees are non-refundable.

Host Payouts. To receive payouts, a Host must complete onboarding with Stripe, including providing any identity verification, tax information, and bank account details Stripe requires, and must agree to the applicable Stripe connected-account terms. Payouts are made to the Host’s designated account, less applicable fees and taxes, subject to any holds, delays, offsets, or reversals permitted under these Terms, required by Stripe, or required by applicable law. We may withhold, delay, or reverse payouts in connection with cancellations, refunds, disputes, chargebacks, suspected fraud, or violations of these Terms.

Cancellations and Refunds. Cancellations and refunds are governed by the cancellation policy displayed in the Listing and at checkout, together with any additional refund rights described on the Platform or required by applicable law. Where a refund is due, it will be issued to the original payment method through Stripe. Hosts who cancel confirmed bookings may be subject to cancellation fees, penalties, or other consequences as described on the Platform.

Taxes Collected Through the Platform. Where required or permitted by applicable law, we (or Stripe on our behalf) may calculate, collect, and remit certain taxes on bookings. The amount of any such taxes will be shown at checkout.

Payments Stay on the Platform. All payments for bookings must be made through the Platform. Users may not make, request, or accept payment for a booking, in whole or in part, outside the Platform, and may not use the Platform to advertise or solicit off-platform transactions.

Appointment as Limited Payment Collection Agent. Each Host appoints the Company (acting through Stripe) as its limited agent solely for the purpose of collecting payments made by Guests on the Host’s behalf. Each Host agrees that payment made by a Guest through the Platform shall be considered the same as a payment made directly to the Host, and the Host will provide the Host Service in the agreed-upon manner as if the Host had received payment directly.

The information presented on or through the Platform is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Platform, or by anyone who may be informed of any of its contents.

This Platform includes content provided by third parties, including materials provided by other Users, including, but not limited to Listings, reviews, and comments, and may include materials provided by bloggers, and third-party licensors, syndicators, aggregators, and/or reporting services. All statements and/or opinions expressed in these materials, and all articles and responses to questions and other content, other than the content provided by the Company, are solely the opinions and the responsibility of the person or entity providing those materials. These materials do not necessarily reflect the opinion of the Company. We are not responsible, or liable to you or any third party, for the content or accuracy of any materials provided by any third parties.

Changes to the Platform

We may update the content on this Platform from time to time, but its content is not necessarily complete or up-to-date. Any of the material on the Platform may be out of date at any given time, and we are under no obligation to update such material.

All information we collect on this Platform is subject to our Privacy Policy (https://huntnhook.com/legal/privacy). By using the Platform, you consent to all actions taken by us with respect to your information in compliance with the Privacy Policy.

You may link to our homepage or your Listing, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval, or endorsement on our part without our express written consent.

This Platform may provide certain social media integrated features.

You may use these features solely as they are provided by us and solely with respect to the content they are displayed with, and otherwise in accordance with any additional terms and conditions we provide with respect to such features. Subject to the foregoing, you must not:

• Establish a link from any website that is not owned by you.
• Cause the Platform or portions of it to be displayed on, or appear to be displayed by, any other site, for example, framing, deep linking, or in-line linking.
• Link to any part of the Platform other than the homepage or your Listing.
• Otherwise take any action with respect to the materials on this Platform that is inconsistent with any other provision of these Terms of Use.

The website from which you are linking, or on which you make certain content accessible, must comply in all respects with the Content Standards set out in these Terms of Use.

You agree to cooperate with us in causing any unauthorized framing or linking immediately to stop. We reserve the right to withdraw linking permission without notice.

We may disable all or any social media features and any links at any time without notice in our discretion.

The Platform may contain links to websites and resources provided by third parties (“Third-Party Websites”), including to Third-Party Websites offering insurance or related services. These links are provided for your convenience only. The inclusion of any link does not imply endorsement by the Company of the Third-Party Website. We have no control over the contents of Third-Party Websites and accept no responsibility for them or for any loss or damage that may arise from your use of them. If you decide to access any of the Third-Party Websites linked to this Platform, you do so entirely at your own risk and subject to the terms and conditions of use for such websites.

The User acknowledges and agrees that the Company is not responsible for the availability or contents of Third-Party Websites. The Company makes no warranties or representations regarding the content, accuracy, reliability, security, or privacy practices of Third-Party Websites. The User assumes all risks associated with accessing and using Third-Party Websites, including any reliance on the accuracy, completeness, or usefulness of their content. The User agrees to hold the Company harmless from any claims or damages arising from the User's use of or reliance on the content of Third-Party Websites. The Company reserves the right to terminate any link to a Third-Party Website at any time. However, this will not necessarily terminate the User's ability to access the Third-Party Website outside the Platform. The User acknowledges and agrees that this provision is an essential basis of the agreement between the User and the Company. The User's access to Third-Party Websites through links on the Platform would not be granted without acceptance of this provision.

The owner of the Platform is a Delaware corporation with its principal place of business in the State of California, in the United States. We provide this Platform for use only by persons located in the United States. We make no claims that the Platform or any of its content is accessible or appropriate outside of the United States. Access to the Platform may not be legal by certain persons or in certain countries. If you access the Platform from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.

You understand that we cannot and do not guarantee or warrant that files available for downloading from the internet or the Platform will be free of viruses or other destructive code. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for anti-virus protection and accuracy of data input and output, and for maintaining a means external to our site for any reconstruction of any lost data. TO THE FULLEST EXTENT PROVIDED BY LAW, WE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY A DISTRIBUTED DENIAL-OF-SERVICE ATTACK, VIRUSES, OR OTHER TECHNOLOGICALLY HARMFUL MATERIAL THAT MAY INFECT YOUR COMPUTER EQUIPMENT, COMPUTER PROGRAMS, DATA, OR OTHER PROPRIETARY MATERIAL DUE TO YOUR USE OF THE PLATFORM OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE PLATFORM OR YOUR DOWNLOADING OF ANY MATERIAL POSTED ON IT, OR ON ANY PLATFORM LINKED TO IT.

YOUR USE OF THE PLATFORM, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE PLATFORM IS AT YOUR OWN RISK. THE PLATFORM, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE PLATFORM ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, NEITHER THE COMPANY NOR ANYONE ASSOCIATED WITH THE COMPANY REPRESENTS OR WARRANTS THAT THE PLATFORM, ITS CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE PLATFORM WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE PLATFORM OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE PLATFORM WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

TO THE FULLEST EXTENT PROVIDED BY LAW, THE COMPANY HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

To the fullest extent provided by law, neither we (including our affiliates and personnel) nor any other party involved in creating, producing, or delivering the Platform or any content therein will be liable for any incidental, special, exemplary or consequential damages, including lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services, or for any damages for personal or bodily injury or emotional distress arising out of or in connection with (i) these Terms, (ii) the use of or inability to use the Platform or any content therein, (iii) any communications, interactions or meetings you may have with someone you interact or meet with through, or as a result of, your use of the Platform, (iv) publishing or booking of a Listing, including the provision or use of Host Services, or (v) hunting, fishing, the possession and/or use of firearms, other weapons, devices or hunting or fishing methods and practices, and the possession and/or use and/or transportation of any hunted game or caught fish, whether based on warranty, contract, tort (including negligence), product liability or any other legal theory, and whether or not the Company has been informed of the possibility of such damage, even if a limited remedy set out in these Terms is found to have failed of its essential purpose.

Except for our payment-related obligations under Payments, Fees, and Payouts above, in no event will our aggregate liability for any claim or dispute arising out of or in connection with these Terms, your interaction with any Users, or your use of or inability to use the Platform, any content therein, or any Host Service, exceed: (A) to Guests, the amount you paid as a Guest during the 12-month period prior to the event giving rise to the liability, (B) to Hosts, the amount paid to you as a Host in the 12-month period prior to the event giving rise to the liability, or (C) to anyone else, one hundred U.S. dollars (US$100).

These limitations of liability and damages are fundamental elements of the agreement between you and us. If applicable law does not allow the limitations of liability set out in these Terms, the above limitations may not apply to you.

To the maximum extent permitted by applicable law, you agree to release, defend, indemnify, and hold harmless the Company, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Use or your use of the Platform, including, but not limited to, your User Contributions, any use of the Platform's content, services, and products other than as expressly authorized in these Terms of Use, or your use of any information obtained from the Platform, or your improper use of the Platform, your interaction with any User, stay at or provision of an Accommodation, participation in or provision of a Host Service, hunting, fishing, the possession and/or use of firearms, other weapons, devices or hunting or fishing methods and practices, and the possession and/or use and/or transportation of any hunted or fished items, including without limitation any injuries, losses or damages (whether compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of such interaction, stay, provision, participation or use, or your failure to accurately report, collect or remit Taxes, or your breach of any laws, regulations or third-party rights such as intellectual property or privacy rights.

All matters relating to the Platform and these Terms of Use, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Delaware without giving effect to any choice or conflict of law provision or rule (whether of the State of Delaware or any other jurisdiction).

Any legal suit, action, or proceeding arising out of, or related to, these Terms of Use or the Platform shall be instituted exclusively in the federal courts of the United States or the courts of the State of California, in each case located in the County of Los Angeles, California, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms of Use in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE PLATFORM MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

No waiver by the Company of any term or condition set out in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

The agreement between you and us reflected by these Terms is effective when you access the Platform (for example to create an account) and remains in effect until either you or we terminate the agreement in accordance with these Terms.

You may terminate this agreement at any time by sending us an email at team@huntnhook.com or by deleting your account. We may terminate this agreement and your account for any reason by providing you 30 days’ notice via email or using any other contact information you have provided for your account. We may also terminate this agreement immediately and without notice and stop providing access to the Platform if you breach these Terms or our policies, you violate applicable laws, or we reasonably believe termination is necessary to protect the Company, Users, or third parties. If your account has been inactive for more than two years, we may terminate your account without prior notice.

The Company may take any action it determines is reasonably necessary to comply with applicable law, or the order or request of a court, law enforcement, or other administrative agency or governmental body.

If you are a Host and terminate your account, any confirmed booking(s) will be automatically canceled and your Guests will receive a full refund. If you terminate your account as a Guest, any confirmed booking(s) will be automatically canceled and any refund will depend upon the terms of the booking, including the applicable cancellation policy. When this agreement has been terminated, you are not entitled to a restoration of your account or any of your content. If your access to or use of the Platform has been limited, or your account has been suspended, or this agreement has been terminated by us, you may not register a new account or access or use the Platform through an account of another User.

Parts of these Terms that by their nature survive termination will survive termination of this agreement.

The Terms of Use and our Privacy Policy constitute the sole and entire agreement between you and the Company regarding the Platform and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Platform.
