Introduction

HuntNHook, Inc., a Delaware corporation (“Company,” “HuntNHook,” “We,” “Us,” or “Our”) respects your privacy and is committed to protecting it through our compliance with this Privacy Policy.

This Privacy Policy describes the types of information we may collect from you or that you may provide when you visit the website at huntnhook.com and/or use the HuntNHook mobile application for iOS and Android (together, the “Platform”) and our practices for collecting, using, maintaining, protecting, and disclosing that information.

HuntNHook operates an online marketplace that connects guests (“Guests”) with hosts (“Hosts”) who offer bookable outdoor experiences, including guided and self-guided fishing and hunting trips and related outdoor activities (“Listings”).

This Privacy Policy applies to information we collect:

  • On this Platform.
  • In phone calls, email, text, messaging applications or social media messages, forums, web chats, social media groups and other electronic messages between you and the Platform or the Company.
  • Through the HuntNHook mobile application, which provides dedicated non-browser-based interaction between you and this Platform.

It does not apply to information collected by:

  • Us offline or through any other means, including on any other website operated by Company or any third party (including our affiliates and subsidiaries); or
  • Any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or through the Platform.

Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our Platform. By accessing or using this Platform, you agree to this Privacy Policy. This Privacy Policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of this Platform after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

Persons Under the Age of 18

Our Platform is not intended for persons under 18 years of age. No one under age 18 may provide any information to or on the Platform. We do not knowingly collect personal information from persons under the age of 18. If you are under 18, do not use or provide any information on this Platform or through any of its features, register on the Platform, create an account, make any purchases or reservations through the Platform, use any of the interactive or public comment features of this Platform, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a person under the age of 18, we will delete that information. If you believe we might have any information from or about a person under the age of 18, please contact us at team@huntnhook.com.

Information We Collect About You

We collect several types of information from and about users of our Platform, including information:

  • By which you may be personally identified, such as name, date of birth, postal address, email address, telephone number, profile photo, social media profile information or any other identifier by which you may be contacted online or offline (“personal information”);
  • That is about you but individually does not identify you, such as IP address, browser type and version, operating system, device information, time and date of visit, approximate geographic location based on IP address, session duration, search queries, and other similar information;
  • About your internet connection, the equipment you use to access our Platform, and usage details.

We collect this information:

  • Directly from you when you provide it to us.
  • Automatically as you navigate through the Platform. Information collected automatically may include usage details, IP addresses, and information collected through cookies and other tracking technologies.
  • From third parties, for example, our business partners and third-party services you have chosen to link to your account or use with the Platform, such as Google (if you sign in with Google), Apple (if you sign in with Apple), and Stripe (our payments partner).

Information You Provide to Us

The information we collect on or through our Platform may include:

  • Information that you provide by filling in forms on our Platform, or by registering or creating an account or Listing, or verifying an account or Listing. This includes information provided at the time of registering to use our Platform, subscribing to our service, posting material, or requesting further services. We may also ask you for information when you report a problem with our Platform or our services or other matters.
  • Contact, Account, and Profile Information. Such as your first name, last name, gender, phone number, city, state, postal code, email address, date of birth, bio, and profile photo, some of which will depend on the features you use.
  • Listing Information (Hosts). All information included in Listings, including trip titles and descriptions, photos, pricing, availability, policies, and the physical address and geographic coordinates of the location where the experience is offered.
  • Booking Information. Details of bookings and transactions you carry out through our Platform, such as trip dates, number of participants, add-on services, reservation codes, amounts paid or received, cancellations, and refunds.
  • Communications. Messages you exchange with other users through the Platform (including any photo attachments), and records and copies of your correspondence (including email addresses) if you contact us or our support team.
  • Reviews and Ratings. Reviews you write about Hosts or Guests, ratings, review photos, and any private feedback you submit alongside a review (private feedback is visible to the person it is about and to our administrators, but is not published publicly).
  • Payment Information. Payments on the Platform are processed by our third-party payments partner, Stripe. When you make a booking, your payment card details are collected and processed directly by Stripe. We do not store your full card number on our servers. We receive and retain limited payment information from Stripe, such as transaction identifiers, payment status, card brand, and the last four digits of your card (for example, so you can recognize and reuse a saved payment method).
  • Payout and Identity Verification Information (Hosts). To receive payouts, Hosts must complete onboarding with Stripe, which may include providing government-issued identification, tax information, and bank account details directly to Stripe. This information is collected and processed by Stripe, not by us. We receive verification status and requirement information from Stripe, and payout records such as amounts and payout status.
  • Notification Preferences. Your choices about which email and push notifications you wish to receive.
  • Reports and Safety Submissions. Information you provide when you report a Listing, review, or another user, or otherwise flag a concern to us.
  • Your responses to surveys that we might ask you to complete for research purposes.
  • Your search queries on the Platform.
  • Information Needed to Use the Platform. We collect personal information about you when you use the Platform. Without it, we may not be able to provide all services requested.
  • Information You Choose to Give Us. You can choose to provide us with additional personal information.

You also may provide information to be published or displayed (hereinafter, “posted”) on public areas of the Platform, such as Listings, profiles, and Reviews, or transmitted to other users of the Platform or third parties (collectively, “User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. Although we may limit access to certain pages, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Platform with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

Information We Collect Through Automatic Data Collection Technologies

As you navigate through and interact with our Platform, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your visits to our Platform, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Platform.
  • Information about your computer or mobile device and internet connection, including your IP address, operating system, and browser type. When you sign in, we associate your session with the IP address and browser or device (user agent) used, for security and account-protection purposes.
  • Geolocation Information. Such as approximate location determined from your IP address or, if you grant permission on your mobile device, more precise location from your device’s location services (for example, to help you search for trips near you). You can control location permissions through your device settings.
  • Usage Information. Such as searches for Listings, bookings you have made, additional services you have added, access dates and times, the pages you’ve viewed or engaged with before or after using the Platform, and other actions on the Platform, including the pages or content you view and links you click to third-party applications. We may collect some of this information even if you haven’t created an account or logged in.
  • Device Information. Such as IP address, hardware and software information, device identifiers, device event information, crash and error data, push notification tokens (if you enable push notifications on the mobile app), and message read receipts.
  • Payment Transaction Information. Such as payment status, transaction identifiers, payment method type, amounts, dates, taxes, and refund or dispute status associated with your bookings, received from or shared with our payments partner, Stripe.

The information we collect automatically may include personal information. We may maintain it or associate it with personal information we collect in other ways or receive from third parties. It helps us to improve our Platform and to deliver a better and more personalized service, including by enabling us to:

  • Estimate our audience size and usage patterns.
  • Store information about your preferences, allowing us to customize our Platform according to your individual interests.
  • Improve the Platform and your user experience.
  • Speed up your searches.
  • Recognize you when you return to our Platform.
  • Diagnose and fix errors, crashes, and performance issues.

The technologies we use for this automatic data collection may include:

  • Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer or mobile device. We use first-party cookies to keep you signed in and to operate the Platform securely. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Platform (including staying signed in). Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Platform. For information about managing your privacy and security settings for cookies, see Choices About How We Use and Disclose Your Information.
  • Web Beacons. Pages of our Platform and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related statistics (for example, recording the popularity of certain content and verifying system and server integrity).
  • Error and Performance Monitoring. We use error-monitoring services (such as Sentry) to detect and diagnose crashes, bugs, and performance problems. These services may process technical information such as IP address, device and browser information, and details about the error encountered.
  • Third-Party Service Technologies. Certain features of the Platform rely on third-party services that may collect technical information directly from your device when you use those features, for example, Mapbox (interactive maps and location search) and Stripe (payment processing and fraud prevention). These providers’ use of information is governed by their own privacy policies.

We do not use third-party advertising networks or advertising cookies on the Platform.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information:

  • To present our Platform and its contents to you.
  • To create and maintain your account and enable your use of our products and services.
  • To provide you with information, products, or services that you request from us, including facilitating bookings, payments, refunds, and Host payouts.
  • To enable you to communicate with other users, including messaging between Guests and Hosts about trips and bookings.
  • To publish Listings, profiles, and Reviews you submit.
  • To send you transactional messages, updates, security alerts, booking and payment confirmations, reminders, and account notifications (by email and, if enabled, push notification).
  • To provide you with notices about your account.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
  • To notify you about changes to our Platform or any products or services we offer or provide through it.
  • To allow you to participate in interactive features on our Platform.
  • To process your requests and provide customer support.
  • To perform analytics, debug, fix errors, and conduct research.
  • To develop and improve our products and services.
  • To provide customer service training.
  • To determine your country of residence based on automated review of your account information and your interactions with the Platform.
  • To personalize and customize your experience based on your interactions with the Platform, your search and booking history, your profile information and preferences, and other content you submit.
  • To study and combat discrimination.
  • To detect, prevent, assess, and address fraud, abuse, and security risks, and to conduct risk assessments.
  • To verify or authenticate information provided by you, including identity information. Host identity verification is performed by our payments partner, Stripe, as part of payout onboarding. In addition, where permitted by applicable law, we may (i) undertake checks designed to help verify your identity or background, (ii) screen you against third-party databases or other sources and request reports from service providers, and (iii) obtain reports from public records of criminal convictions or sex offender registrations or their local equivalents.
  • To take any action that we in our sole discretion believe to be necessary or desirable to comply with any KYC (know-your-customer) or AML (anti-money-laundering) laws and regulations, including sanctions screening and enforcement.
  • To calculate, collect, and report applicable taxes on transactions.
  • To comply with our legal obligations, and to protect the health and well-being of our Guests, Hosts, Hosts' employees, and members of the public.
  • To enforce our agreements with third parties.
  • To comply with law, respond to legal requests, prevent harm, and protect our rights.
  • To enforce our Terms of Use and other policies, including our Community Guidelines.
  • To review and act on reports submitted about Listings, reviews, or users, and to moderate content on the Platform.
  • To assess or evaluate your interactions with the Platform and information obtained from third parties.
  • To send you promotional and marketing messages and other information that we think might be of interest to you, where you have opted in to receive them.
  • To invite you to events and relevant opportunities.
  • To determine if you have any unfinished bookings and send you suggestions or reminders.
  • In any other way we may describe when you provide the information.
  • For any other purpose with your consent.

We may also use your information to contact you about our goods and services that may be of interest to you. If you do not want us to use your information in this way, you can adjust your notification preferences in your account settings, or inform us by sending an email to team@huntnhook.com or by another method indicated below under Choices About How We Use and Disclose Your Information.

Disclosure of Your Information

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We may disclose personal information that we collect or you provide as described in this Privacy Policy:

  • To other Users, as necessary to operate the marketplace (see below), and to our affiliates.
  • To contractors, service providers, and other third parties we use to support our business and who are bound by contractual or legal obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them. These currently include: Stripe (payment processing, saved payment methods, Host payouts, identity verification, and tax calculation), our email delivery provider (transactional and account emails), push notification delivery services (mobile push notifications), Mapbox (maps and location search), our cloud hosting, database, and file storage providers (which store account data and uploaded photos), and our error-monitoring provider (crash and error diagnostics).
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Company's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Company about our Platform users is among the assets transferred.
  • To fulfill the purpose for which you provide it.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.

We may also disclose your personal information:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce or apply our Terms of Use available at https://huntnhook.com/legal/terms and other agreements, including for billing and collection purposes.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our Users, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
  • We may also share your information with a third-party verification service provider for purposes of verifying your identity.

Sharing between Guests and Hosts. Because HuntNHook is a two-sided marketplace, certain information is shared between the parties to a booking so the trip can be coordinated and completed. When you request or make a booking, we share with the other party information such as your name, profile information and photo, booking details (dates, party size, add-ons), messages you send them, and reviews you write about them. Public reviews and public profile information are visible to all users of the Platform. Private feedback submitted with a review is shared with the person it is about. Reviews a Host writes about a Guest may also be visible to other Hosts evaluating that Guest’s booking requests.

Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

  • Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of the Platform may then be inaccessible or not function properly (for example, you may not be able to stay signed in).
  • Disclosure of Your Information for Third-Party Advertising. We will not disclose your personal information to third parties for advertising purposes.
  • Promotional Offers from the Company. Promotional and marketing messages are opt-in. If you do not wish to receive promotional communications from us, you can manage your email and push notification preferences at any time in your account’s notification settings, or opt out by emailing us at team@huntnhook.com. If we have sent you a promotional email, you may also use the unsubscribe link in that email or send us a return email asking to omit you from future email distributions. Note that you cannot opt out of essential transactional messages (such as booking confirmations, payment receipts, and security alerts), which are required to provide the service.
  • Push Notifications. You can turn push notifications on or off at any time through your account’s notification settings or your device settings.
  • Location Permissions. You can control the mobile app’s access to your device’s location through your device settings.

Accessing and Correcting Your Information

You can review and change your personal information by logging into the Platform and visiting your account settings and profile pages.

You may also send us an email at team@huntnhook.com to request access to, correct, or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. We may also retain certain information where required for legitimate business or legal purposes, such as records of completed transactions, payout and tax records, security and audit logs, and information related to disputes or violations of our Terms of Use.

If you delete your User Contributions from the Platform, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Platform users. Proper access and use of information provided on the Platform, including User Contributions, is governed by our Terms of Use available at https://huntnhook.com/legal/terms.

Your State Privacy Rights

State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information.

To learn more about California residents’ privacy rights, visit https://oag.ca.gov/privacy/ccpa.

Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, and Virginia provide (now or in the future) their state residents with rights to:

  • Confirm whether we process their personal information.
  • Access and delete certain personal information.
  • Correct inaccuracies in their personal information, taking into account the information's nature and processing purpose (excluding Iowa and Utah).
  • Data portability.
  • Opt out of personal data processing for targeted advertising (excluding Iowa), sales, or profiling in furtherance of decisions that produce legal or similarly significant effects (excluding Iowa and Utah).
  • Either limit (opt out of) or require consent to process sensitive personal data.

Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. Information you provide to us is stored on secure servers. All information transmitted between your device and the Platform (including payment transactions, direct messages between Users, and account information) is encrypted in transit using TLS (SSL) technology. Payment card numbers and bank account details are collected and processed directly by our payments partner, Stripe, and are never stored on our servers. Passwords are stored only in hashed form.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Platform, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Platform, such as Listings, profiles, and Reviews. The information you share in public areas may be viewed by any user of the Platform.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Platform. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Platform.

Changes to Our Privacy Policy

It is our policy to post any changes we make to our Privacy Policy on this page with a notice that the Privacy Policy has been updated on the Platform home page. If we make material changes to how we treat our users' personal information, we will notify you by email to the primary email address specified in your account and/or through a notice on the Platform home page. The date the Privacy Policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Platform and this Privacy Policy to check for any changes.
